Terms of Service

1. Agreement and eligibility

These Terms of Service ("Terms") are a contract between you and Bree Pear, the developer and operator of Dexeon ("we", "us"). They cover the Dexeon iOS app, the website at dexeontcg.com, shared binder pages, and any related services (the "Service"). By installing or using the Service you agree to these Terms and to our Privacy Policy, which explains what we collect and why. If you don't agree, don't use the Service.

You must be at least 13 years old to use Dexeon. To create an account, publish a profile, or send messages you must also be old enough to form a binding contract and to consent to data processing where you live. If you're under 18, a parent or guardian should review these Terms with you.

2. The Service and the beta

Dexeon lets you track a card collection against a species list, browse card printings with market prices, scan cards with your camera to identify them, build and share binders, and, with an account, connect with other collectors through profiles, direct messages, a community trade board and leaderboards.

Dexeon is currently distributed as a beta through Apple's TestFlight. Beta software is unfinished by nature: features may be added, changed or removed, and bugs may cause data to be lost or displayed incorrectly. Please keep your own records of anything you can't afford to lose; binders can be exported as PDF or CSV at any time. Your use of TestFlight is also subject to Apple's TestFlight terms.

Price. During the beta, Dexeon is free for testers. At public launch the app will be sold on the App Store for a one-time price of US$5.99 (or the local equivalent Apple sets), which covers the app as it exists then and its updates. At launch there is no advertising and nothing else to buy inside the app. Purchases are made through Apple, and Apple's App Store terms govern billing and refunds; we don't receive your payment details. Early adopters. A limited number of beta participants, chosen by us before public launch, will receive the released app at no charge for as long as it's offered on the App Store. We'll tell those people directly how it's delivered (for example, an App Store promo code). Spots are limited, the offer closes when we announce that the early-adopter window has ended, and it can't be transferred or exchanged for cash. Beta builds distributed through TestFlight expire when the beta ends, and beta access by itself doesn't entitle you to the released version unless you've been confirmed as an early adopter. Running Dexeon has ongoing costs — the card and pricing data, and the servers behind sync, messaging and the trade board — so we may introduce optional paid features, or a subscription for server-backed features, in the future. If we do, these Terms will be updated first, we will say so in the app before anything changes, and nothing you have already paid for will be taken away.

3. Your account

• You can use the core of the app without an account. An account is required for sync, profiles, messaging, trading and leaderboards.
• You're responsible for keeping your sign-in credentials secure and for everything that happens under your account. Tell us promptly if you believe it's been compromised.
• One account per person. Don't create accounts for others, share accounts, or create extra accounts to evade a block, a suspension, or to manipulate leaderboards.
• Usernames are first come, first served, must not impersonate another person, brand or Dexeon itself, and must comply with the community rules. We may reclaim, change or release a username that violates these Terms, infringes someone's rights, or has been inactive for an extended period.
• You can delete your account at any time in Settings. Section 11 explains what happens when you do.

4. Your content

"Your content" means everything you add to Dexeon: collection records, notes, binders, custom card photos, your profile (username, name, bio, avatar, links), messages, trade listings, and reports.

You own your content. We claim no ownership of it.

You give us a license to run the Service. So that Dexeon can work, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display and adapt (for example, resize an avatar or render a binder page on the web) your content, solely to provide, secure and improve the Service and as described in the Privacy Policy. Where you choose to make content visible to others, this license includes showing it to them: a public binder to anyone with the link, a trade listing to signed-in users, a message to its recipient. The license ends when you delete the content or your account, except that copies already delivered to other users (a message they received, a binder they viewed) and copies in routine backups may persist for a limited time.

You're responsible for it. You confirm that you have the right to post your content and that it doesn't violate these Terms, the law, or anyone else's rights. Custom card photos must be photos you took of cards you own. Don't upload other people's photos, scans of copyrighted artwork you don't have rights to, or anything you're not allowed to share.

Feedback. If you send us suggestions or feedback, we may use them without obligation to you.

5. Community rules

Dexeon is a place for collectors to talk cards. Before your first message you'll be asked to agree to the Community Guidelines shown in the app; those guidelines are part of these Terms. In short, you may not post, send or list anything that is:

• Hateful, or that attacks people based on race, ethnicity, national origin, religion, disability, gender, sexual orientation or similar characteristics.
• Threatening, violent, harassing, bullying, or intended to intimidate.
• Sexually explicit, or that sexualizes minors in any way.
• Fraudulent, deceptive or a scam, including fake listings, counterfeit cards presented as genuine, and bait-and-switch trades.
• Spam, unsolicited advertising, or repetitive or automated messaging.
• Someone else's private information shared without consent.
• Illegal, or that promotes illegal activity.
• Impersonation of another person, organization or of Dexeon.

Ordinary trash talk between collectors is fine. Hate and threats are not, and we have zero tolerance for them. Messages pass through an automated check on your device and on our servers; content that trips it is not delivered. Every profile, message and listing has Block and Report. We review reports and may remove content, restrict features, or terminate accounts at our discretion, with or without notice. We may also preserve and share content with law enforcement where required.

6. Trading

The Community Trades board and direct messages let collectors find each other and talk. Dexeon is not a marketplace and is not a party to any trade. Specifically:

• We don't process payments, hold funds, provide escrow, or arrange shipping. Any exchange of cards or money happens entirely between you and the other person, on terms you agree, using methods you choose.
• We don't inspect, grade, authenticate or guarantee any card, its condition, or that a listing is accurate or that the person behind it will follow through.
• A listing's price is the market estimate at the time it was listed. It is not an offer to sell at that price and is not verified by us.
• You are responsible for complying with the laws that apply to you, including any tax, consumer or import rules, and for the risks of dealing with strangers. Use common sense: meet in safe places, use payment methods with buyer and seller protection, and never share more personal information than a trade needs.
• We are not liable for any loss arising from a trade, a failed trade, or a dispute between users. If you believe another user has scammed you, report them in the app so we can act on their account, and contact the appropriate authorities.

Tips

If you choose to support development through the Venmo link on our website, that's a voluntary gift made on Venmo's platform under Venmo's terms. Tips don't purchase features, access or priority, aren't refundable by us, and don't change the price of the app.

7. Card data and prices

Card names, set information, artwork, identification and market prices are supplied by third parties, principally Scrydex and TCGplayer, and refreshed on a schedule. Prices and collection values shown in Dexeon are estimates for your information only. They may be incomplete, out of date or wrong, may not cover every card or variant, and are not an appraisal, a valuation for insurance or sale, or financial advice. Scanning identifies the most likely match; always confirm the card yourself. Don't make financial decisions based solely on figures in the app.

8. Intellectual property

Dexeon's own work. The Dexeon name, wordmark, logo, app, website, design, code and original content are owned by Bree Pear and protected by copyright, trademark and other laws. We grant you a personal, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by the App Store or TestFlight terms. You may not copy, modify, distribute, sell, rent, reverse engineer or create derivative works from the Service except as the law allows.

Third-party rights. Dexeon is an unofficial, fan-made application for personal use. It is not affiliated with, endorsed by, or sponsored by Nintendo, Game Freak, Creatures Inc., or The Pokémon Company. Card names, characters, artwork and images are the property of their respective owners and are displayed for identification and organization of cards you collect. Card data and images are provided under license from Scrydex. Nothing in these Terms grants you any right to those third-party materials beyond viewing them inside the Service.

Takedown requests. If you believe content in the Service infringes your rights, email us at the address in section 19 with a description of the work, the location of the material, your contact details, and a statement that you believe in good faith the use is unauthorized. We respond promptly and may remove content and terminate repeat infringers.

9. Acceptable use

In addition to the community rules, you agree not to:

• Access the Service or its data by any automated means, scrape it, or use it to build a dataset or competing product.
• Extract, share or misuse API credentials embedded in the app, or make requests to our data providers using them outside the app.
• Probe, bypass or interfere with security, rate limits, content checks or access controls.
• Falsify collection data, stats or game scores to manipulate leaderboards, or use multiple accounts to do so.
• Upload malware or anything designed to disrupt the Service or other users' devices.
• Use the Service for any commercial purpose, such as running a shop through the trade board, without our written permission.

10. Leaderboards and seasons

The Gym Leaders board ranks discoverable accounts by stats the app publishes from your collection, such as Full Dex percent, sets completed, weekly catches and the mini-game high score. Rankings are for fun. Weekly seasons roll over automatically; we may adjust, reset or remove rankings, correct stats that appear inaccurate, and exclude accounts we believe are gaming the system. No prizes or compensation are attached to any ranking unless we say so in writing.

11. Suspension and termination

By you. Delete your account in Settings at any time. Deleting removes your data as described in the Privacy Policy. Messages already delivered to other users remain in their conversations.

By us. We may suspend or terminate your access, remove content, or restrict features if you violate these Terms, create risk or legal exposure for us or other users, or if we discontinue the Service. Where practical we'll give you notice and a chance to export your binders. Sections 4 (license for delivered copies), 7, 8, 12 through 15, and 17 through 19 survive termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DON'T WARRANT THAT CARD DATA, PRICES OR SCAN RESULTS ARE ACCURATE, THAT YOUR DATA WILL NOT BE LOST, OR THAT OTHER USERS WILL BEHAVE HONESTLY. SOME JURISDICTIONS DON'T ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BREE PEAR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL OR CARDS, ARISING OUT OF OR RELATED TO THE SERVICE, ANY TRADE OR INTERACTION WITH ANOTHER USER, OR ANY THIRD-PARTY DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF FIFTY US DOLLARS (US$50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICH FOR A FREE SERVICE IS ZERO. THESE LIMITS DON'T APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR, WHERE YOU ARE A CONSUMER IN THE EU OR UK, YOUR STATUTORY RIGHTS.

14. Indemnity

You agree to defend and hold us harmless from claims, losses and expenses, including reasonable legal fees, arising from your content, your trades or dealings with other users, your violation of these Terms, or your violation of any law or third-party right.

15. Apple

The app is distributed through Apple's TestFlight and, in the future, the App Store. These Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it, including product liability, consumer protection, or intellectual property claims; those are our responsibility to the extent permitted by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US government embargo or designated a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties. You must also comply with any applicable third-party terms when using the app, such as your wireless carrier's.

16. Changes

We may update these Terms as the Service evolves. We'll change the effective date at the top and, for material changes, tell you in the app or on the website before they take effect. Continuing to use the Service after a change means you accept the new Terms. If you don't, stop using the Service and delete your account.

17. Governing law and disputes

These Terms are governed by the laws of the State of [Your State], United States, without regard to conflict-of-law rules, and by applicable US federal law. Before filing any claim, you agree to contact us and try in good faith to resolve it informally for 30 days. Any dispute that can't be resolved informally will be brought in the state or federal courts located in [Your State], and you consent to their jurisdiction, except that either party may seek an injunction to protect intellectual property in any court with jurisdiction. If you're a consumer in the EU, UK or another jurisdiction that gives you the right to bring claims at home under your local law, nothing here takes that away.

18. General

• These Terms, the Community Guidelines and the Privacy Policy are the entire agreement between you and us about the Service.
• If any part is found unenforceable, the rest stays in effect.
• Our not enforcing a provision isn't a waiver of it.
• You may not assign these Terms. We may assign them in connection with a transfer of the Service, with notice to you.
• Nothing in these Terms creates a partnership, employment or agency relationship.
